1 Acceptance of Terms

By accessing or using TRSH services (including our website, tutoring sessions, materials, or any related offerings), you confirm that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. These documents together form the entire agreement between you and TRSH.

2 Service Description

TRSH provides personalised tutoring and educational support services to learners across various academic levels and subjects. Our services may include:

• One-on-one and group tutoring sessions (online or in-person)
• Academic assessments and progress tracking
• Study materials and educational resources
• Educational consultation and guidance

We reserve the right to modify, suspend, or discontinue any part of our services at any time, with or without notice, at our sole discretion.

3 Registration and Account Responsibilities

To access certain services, you may be required to create an account. You agree to:

• Provide accurate, complete, and current information during registration
• Maintain the confidentiality and security of your account login credentials
• Notify us immediately of any unauthorised access or suspected breach of your account
• Accept full responsibility for all activities that occur under your account
• Promptly update your account information if any details change

4 Payment Terms

All tutoring sessions and services must be paid for in advance, unless otherwise agreed in writing.

• Fees are non-refundable except as expressly provided in our Cancellation Policy or as required by law.
• We accept payment through secure third-party payment gateways.
• Late or non-payment may result in the suspension or termination of services.
• We reserve the right to change our fees upon 30 days’ written notice.
• Any billing disputes must be raised in writing within 30 days of the invoice date.

5 Cancellation and Rescheduling Policy

Cancellations or rescheduling of sessions require at least 24 hours’ prior written notice.

• Cancellations made with less than 24 hours’ notice, or no-shows, will be charged the full session fee.
• Emergency situations will be considered on a case-by-case basis at our discretion.
• Repeated late cancellations or no-shows may result in the suspension or termination of services.

6 Code of Conduct

All participants (learners, parents/guardians, and tutors) must conduct themselves professionally and respectfully. You agree to:

• Treat tutors, staff, and other learners with courtesy and respect
• Attend sessions punctually and prepared
• Refrain from disruptive, abusive, discriminatory, or inappropriate behaviour
• Comply with all health, safety, and security guidelines during in-person sessions

Any violation of this Code of Conduct may result in immediate termination of services without refund.

7 Intellectual Property

All tutoring materials, resources, lesson plans, assessments, recordings (where permitted), and content provided by TRSH are our exclusive intellectual property, protected by copyright and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable licence to use the materials solely for your personal educational purposes during the term of your tutoring engagement. You may not:

• Copy, reproduce, distribute, sell, or share our materials without our prior written consent
• Record any tutoring session without the explicit written consent of TRSH and all participants
• Use our content for any commercial purpose or create derivative works

8 Academic Integrity

TRSH is committed to ethical education. Our role is to provide guidance, explanation, and support to help learners understand concepts and improve their skills. We do not:

• Complete assignments, projects, or assessments on behalf of learners
• Encourage or assist in any form of academic dishonesty

Learners and parents remain fully responsible for ensuring that all submitted work complies with their school, college, or university’s academic integrity policies.

9 Limitation of Liability

To the fullest extent permitted by South African law:

• TRSH provides its services on an “as is” basis without any warranties, express or implied.
• We do not guarantee any specific academic results, grade improvements, or examination outcomes.
• Our total liability to you shall not exceed the total fees paid by you to TRSH in the 12 months preceding the claim.
• We are not liable for any indirect, incidental, consequential, or punitive damages, including loss of profits, data, or academic opportunity.

Academic success depends on many factors beyond tutoring, including the learner’s effort, aptitude, and external circumstances. Parents and learners acknowledge this reality.

Nothing in these Terms limits any rights you may have under applicable consumer protection legislation.

10 Privacy and Data Protection

Your privacy is important to us. These Terms incorporate our Privacy Policy by reference. By using our services, you consent to the collection, processing, and use of your personal information (and that of any learner you enrol) as described in the Privacy Policy. We process all personal information in accordance with the Protection of Personal Information Act (POPIA) and other applicable South African laws.

11 Termination

You may terminate services at any time by providing written notice.

• TRSH may terminate or suspend services immediately, without prior notice, if you breach any of these Terms, fail to make payment, engage in inappropriate conduct, or for any other reason we reasonably deem necessary.
• Upon termination, you remain liable for any outstanding fees, and no refunds will be issued except as required by law.

12 Dispute Resolution

Any dispute arising from these Terms or our services shall first be attempted to be resolved through good-faith negotiation. Failing that, the dispute shall be subject to the exclusive jurisdiction of the South African courts and governed by the laws of the Republic of South Africa.

• You agree that any legal action must be brought within 12 months of the event giving rise to the claim (or the shortest period permitted by law, if longer).

13 Force Majeure

TRSH shall not be liable for any delay or failure to perform its obligations if such delay or failure is caused by events beyond our reasonable control, including (but not limited to) acts of God, pandemics, government restrictions, war, civil unrest, strikes, technical failures, or internet disruptions.

14 Amendments

We reserve the right to update or modify these Terms of Service at any time. Material changes will be notified to you by email or via a prominent notice on our website at least 14 days before they take effect. Continued use of our services after the effective date constitutes your acceptance of the revised Terms.
